TERMS & CONDITIONS OF AUCTION

1. REGISTRATION:  Bids will be accepted only from registered bidders.  Registration begins at 10:00AM.  Please bring a valid driver’s license for identification.
2. AUCTION SALE:  The personal property will be sold ABSOLUTE to the highest bidder. All bidders are responsible to determine the age, type, description and condition of all items purchased and should inspect before bidding.  Each item is auctioned “AS IS, WHERE IS” with all faults in its condition at the time of sale without recourse by way of refund, reduction of the purchase price, or otherwise.  Bidders should perform such independent investigation with respect to the personal property as they deem necessary or appropriate. ALL SALES ARE FINAL.
3. AGENCY:  The Auction Company and its representatives represent the Seller.
4. ANNOUNCEMENTS:  Announcements on day of sale take precedence over all prior releases, verbal and written, concerning this auction sale.
5. BIDDING: The auctioneer will determine all bid increments. All decisions by the auctioneer are final.
6. BUYER’S PREMIUM:  The Buyer’s Premium on all personal property is 10% of the high bid amount.  The Buyer’s Premium will be added to the high bid to determine the final sale price.
7. SALES TAX: This is a business liquidation, so no sales tax will be charged on the personal property.
8. PAYMENT: All items must be paid in full on sale day by cash, personal or business check made payable to Woltz & Associates, Inc.   If paid by check, titles and keys to vehicles will be provided upon the clearing of a personal or business check. Buyers will be provided a Bill of Sale on the trailers and farm cars.
9. REMOVAL OF PERSONAL PROPERTY: Personal property becomes the responsibility of the buyer at the time of the sale. The Auction Company does not provide equipment or labor to remove items purchased.  Personal property must be removed from the property by 6:00 PM on sale day unless other arrangements are made.
10. INVENTORY LIST: The Auction Company will have an inventory of personal property available on sale day and upon request. The inventory list will also be available at www.woltz.com.
11. ASSUMPTION OF RISK: Bidders inspecting the property enter at their own risk. Auction Company and Seller assume no risk for bodily injury or damage to personal property.
12. GENERAL: The information provided is subject to verification by all parties relying upon it. No liability for its accuracy or any errors or omissions is assumed by Seller or Auction Company.
