  1. AGENCY:  THE AUCTION COMPANY AND ITS REPRESENTATIVES REPRESENT THE SELLER, RICHARD E. BIEMILLER, SUBSTITUTE TRUSTEE.  A copy of the Notice of Substitute Trustee’s Sale is available for review at www.woltz.com and states the terms of the sale which are controlling if there is any conflict with this summary of basic terms.
  2. REGISTRATION:  Bids will be accepted only from registered bidders. Registration begins on site at 1:00 PM.  Please bring a driver’s license for identification.
  3. TERMS OF SALE:  The real estate is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” All information provided by the Auction Company is obtained from sources it believes are reliable; however, it is not warranted. Potential bidders are responsible for conducting their own independent inspections, investigations, inquires and due diligence regarding the property. Inspection of the property is at the potential bidder’s risk. ALL SALES ARE FINAL. 
  4. ANNOUNCEMENTS: Announcements day of sale take precedence over all prior communications, verbal and written, concerning this sale. The Trustee may amend or supplement the terms of sale by verbal or written announcements before bidding commences.
  5. BIDDING:  The auctioneer will determine bid increments. The secured creditor may bid to protect its interest.
  6. BUYER’S PREMIUM:  A Buyer’s Premium will be charged. The Buyer’s Premium on real estate is five percent (5%) of the high bid amount. The Buyer’s Premium is added to the high bid amount to determine the sale price.
  7. DEPOSIT:  A deposit in the amount of ten percent (10%) of the sale price (high bid plus Buyer’s Premium) will be required on day sale. The deposit is payable by cash, certified check or cashier’s check. The certified check or cashier’s check should be made payable to the bidder who will endorse it over to Richard E. Biemiller, Substitute Trustee.  
  8. CLOSING DATE FOR REAL ESTATE:  The balance of the purchase price is due at settlement on or before April 15, 2010.
  9. TRANSFER OF TITLE TO REAL ESTATE:  The real estate will be conveyed by special warranty deed subject to all prior liens and to any covenants, conditions, restrictions, easements, defects, encumbrances, adverse claims, matters of survey and leases, if any.  
  10. FINANCING:  The sale of the real estate is a cash transaction and is not conditioned upon the bidder obtaining financing. Bidders should arrange any necessary financing prior to registering to bid.
  11. BIDDER PACKET:  A Bidder Packet with information regarding the real estate will be available from the Auction Company and posted at www.woltz.com.
