From US Route 220 in Rocky Mount, take the US Route 40 west exit. Proceed west following signs for US Route 40, approximately 10.4 miles and go left on Fieldcrest Road (Route 805). Follow .1 mile and go left on Prillaman Switch Road (Route 767). Follow .2 mile and turn left into Scott Manufacturing, Inc. If the front lot is full, continue on Prillaman Switch Road to next driveway on left to access rear parking lot.

REGISTRATION: Bids will be accepted only from registered bidders. Registration begins on site at 9:00 AM. Please bring a driver’s license for identification.
TERMS OF SALE: All real and personal property is sold “AS IS, WHERE IS.” Bidders should perform such independent investigation with respect to the property as they deem necessary or appropriate. ALL SALES ARE FINAL. The Personal Property is being sold ABSOLUTE to the high bidder. The Real Estate is being sold ABSOLUTE to the high bidder, subject to the applicable law and the duties of the Seller as the Substitute Trustee. The successful real estate bidder will be required to execute a Memorandum of Trustee’s Sale, which will be available for review prior to sale.
AGENCY: THE AUCTION COMPANY AND ITS REPRESENTATIVES REPRESENT THE SELLER.
REAL ESTATE AND PERSONAL PROPERTY:
The real estate is being sold pursuant to a Substitute Trustee’s Foreclosure for secured party.The personal property is being sold either by a secured party foreclosing upon the property owned by Scott Manufacturing, Inc., or by the owner of personal property leased to Scott Manufacturing, Inc. The personal property shall be conveyed AS IS, WHERE IS on the date of the sale by bill of sale warranting either that the seller is the lawful owner of the property or that the seller has the right to sell the property, but without any other warranties, including any warranty of merchantability or of fitness for a particular purpose. Buyers of the foreclosed personal property will have such rights in the property as are prescribed in § 8.9-617 of the Uniform Commercial Code as adopted in Virginia.
ANNOUNCEMENTS: Announcements day of sale take precedence over all prior releases, verbal and written, concerning this sale. The Substitute Trustee and/or secured party may amend or supplement the terms of sale by verbal or written announcements before bidding commences.
BIDDING: Subject to the approval of the Substitute Trustee regarding the real estate, the auctioneer will determine bid increments. The auctioneer will determine bid increments for personal property. Secured parties may bid to protect their interest.
BUYER’S PREMIUM: A Buyer’s Premium will be charged. The Buyer’s Premium on real estate is five percent (5%) of the high bid amount. The Buyer’s Premium on personal property is ten percent (10%) of the high bid amount. The Buyer’s Premium is added to the high bid amount to determine the sale price.
DEPOSIT ON REAL ESTATE: A deposit in the amount of ten percent (10%) of the sale price (high bid plus Buyer’s Premium) will be required for the real estate on day of sale. The deposit is payable by cash, cashier’s check, pre-approved personal check made payable to Woltz & Associates, Inc., or wire transfer into the Woltz & Associates, Inc. Escrow Account on sale day. Personal checks will be approved if the Buyer presents, at time of registration, a letter from its bank stating that the Buyer is a customer of the bank and that the account on which the check is drawn is in good standing.
CLOSING DATE FOR REAL ESTATE: The balance of the purchase price is due at settlement on or before August 29, 2008.
TRANSFER OF TITLE: The real estate will be conveyed by special warranty Trustee’s deed, free and clear of liens, subject, however, to any recorded or unrecorded liens, easements, conditions and restrictions to the extent any take priority over the lien of the deed of trust being foreclosed.
BIDDER PACKET: A Real Estate Bidder Packet and an itemized personal property list will be available from the Auction Company and be posted on our website www.woltz.com
PAYMENT FOR PERSONAL PROPERTY: All personal property must be paid in full on day of auction sale by cash, or pre-approved personal or business check payable to Woltz & Associates, Inc. Personal and business checks will be approved if the Buyer presents a bank letter stating that the Buyer is a customer of the bank and the checking account is in good standing. Buyers will be provided a Secured Party Bill of Sale.
REMOVAL OF PERSONAL PROPERTY: Personal property becomes the responsibility of the Buyer at the time of sale. The Auction Company does not provide equipment or labor to remove purchased items. All personal property must be removed from the premises day of sale, by 7:00 PM, or Thursday July 31, Friday August 1 and Saturday August 2 between 9:00 AM and 5:00 PM, unless other arrangements are made with Auction Company and/or Seller.
MACHINERY DISCONNECTS: All electrical, mechanical and plumbing disconnects to machinery must be made in a professional and workman-like manner. Electrical, mechanical and plumbing terminations shall be made at the nearest junction box or union to the equipment. Machinery dust collection hoods and specialized dust collection manifolds will pass with the equipment being sold. Any building penetrations removed (dust collection, piping, etc.) shall be re-sealed in a professional and workman-like manner at the expense of the machinery purchaser.
