Basic Terms & Conditions:
- Bids accepted only from registered bidders. Come early for registration.
- All information provided by Auction Company is deemed reliable, but not warranted. Bidders should perform such independent investigation with respect to the property as they deem necessary or appropriate. Title reports are available for review in court files. Inspection of properties is done at buyer’s risk.
- All property sold to the highest bidder “AS IS, WHERE IS”. Please inspect before bidding. ALL SALES FINAL. Neither the Special Commissioner nor the Auction Company makes any warranties whatever regarding any of the properties.
- Announcements day of sale take precedence over all prior releases, verbal and written, concerning this sale.
- AUCTION COMPANY AND ITS REPRESENTATIVES REPRESENT THE SELLER.
- Properties to be conveyed by deed generally in the form as set forth in Sections 55-48 and 55-69 of the Code of Virginia.
- Deposit of twenty-five (25%) of contract sales price due when contract is signed at sale. Balance due in 10 days at the Special Commissioner’s Office. Properties will close within 10 days of court confirmation, subject to confirmation by the court. Cash, bank check or certified funds only.
- Buyer is purchasing without contingencies. Seller’s sale is contingent only upon court approval.
- All properties are subject to being withdrawn from the sale at the discretion of the Special Commissioner.
- LEAD PAINT: Structure(s) were built prior to 1978 and may contain lead paint. Inspection may be performed at bidder’s option prior to sale day. Applicable lead paint documents and information are available. Prior to signing the memorandum of sale, bidders must execute a lead paint disclosure and agree to waive the ten (10) days right to inspection after the sale. Property will be sold “AS IS, WHERE IS”.
- Five percent (5%) Buyer’s Premium added to high bid to determine contract sales price.
